Quick summary: Arkhas is a platform for displaying and comparing prices published by retailers. We do not sell any product and are not a party to any purchase. Prices are collected automatically and may change at any time — always confirm the price with the retailer before buying. In case of any discrepancy, the Arabic version of these terms prevails.
1. Definitions
"Platform" / "Arkhas": the website arkhaskw.com and any of its subdomains, operated from the State of Kuwait. "User": any person who visits or uses the Platform in any manner. "Retailer": any retail seller whose publicly published product information or prices are displayed on the Platform. "Content": product names, prices, specifications, images, logos and any data displayed on the Platform. "Service": displaying and comparing published information and prices, and directing the User to the Retailer's website.
2. Acceptance of the Terms
By using the Platform you acknowledge that you have read, understood and agreed to be bound by these Terms. If you do not agree to any provision, please do not use the Platform. If you are under eighteen, your use of the Platform must be with the knowledge and consent of your guardian.
3. Nature of the Service
Arkhas is an informational platform for displaying and comparing publicly published prices. It is not a store, a commercial intermediary, or an agent of any retailer. The Platform's role is limited to: collecting publicly published product and price information from retailers' websites; presenting it in a unified format that makes comparison easy; and directing the User — at their choice — to the Retailer's website to complete a purchase. Arkhas does none of the following: selling products, collecting money, processing payments, managing orders, storing goods, shipping or delivery, or providing product warranties.
4. No Party to the Sale Contract
When you move from the Platform to a Retailer's website and complete a purchase, the sale contract is concluded exclusively between you and the Retailer, governed solely by that Retailer's terms and policies. Accordingly, all of the following are the Retailer's responsibility, and Arkhas bears no liability for them: the final price charged, shipping fees, taxes or additional charges; actual stock availability; product quality, conformity with description and authenticity; payment, invoicing and delivery; warranty, maintenance, replacement and returns; after-sales service and complaint handling.
5. Prices and Displayed Data
Prices and specifications are collected automatically from publicly published sources and updated periodically. While Arkhas makes reasonable efforts for accuracy, you acknowledge that: — Prices are not real-time. The date of the last price update is shown on the product page and should be treated as the reference for data age. — A retailer's price may change at any time without prior notice to the Platform. — A product may go out of stock after the last update. — Technical errors may occur in automated collection or display. — A product's specifications or regional version may differ from what is displayed. You must therefore always verify the final price, availability and specifications on the Retailer's website before completing any purchase. The legally operative price is the one displayed by the Retailer at the moment of purchase, not the price displayed on Arkhas.
6. Data Sources and Retailers' Rights
The Platform relies exclusively on information published publicly on retailers' websites and does not access any protected or private data or data requiring login. In dealing with data sources, Arkhas commits to: respecting each site's robots.txt; never bypassing any technical barrier or protection measure; rate-limiting requests so as to have no effect on retailers' site performance; and using a clear User-Agent identifier carrying Arkhas's name and a contact method. Retailer's right to object: any retailer may request correction of its displayed data or removal from display by contacting [email protected]. Arkhas will respond within 7 working days and will honour legitimate requests.
7. Intellectual Property
Third-party rights: all product names, trademarks, service marks, logos, industrial models and designs displayed on the Platform are the exclusive property of their respective owners and rights holders, and are displayed for identification, reference and comparison purposes only. Arkhas acts as an independent party and shall not be considered a representative, agent, employee, sponsor, partner or licensee of any of these mark owners, and no affiliation or official endorsement exists between them. Product images are displayed from their original sources at the retailers or rights holders; Arkhas claims no ownership of them. Arkhas's rights: Arkhas retains all rights to the "Arkhas" name and logo, the Platform's design and interfaces, and the structure, organisation and presentation of its database. These may not be copied or used without prior written permission. Infringement reports: if you are a rights holder and believe content displayed on the Platform infringes your rights, contact [email protected] describing the content in question and the basis of your right; we will review and take appropriate action.
8. Commercial Disclosure and Commissions
Arkhas may earn a commission or financial consideration from some retailers when a user reaches them through the Platform's links or completes a purchase. This commission has no effect whatsoever on: the price you pay — it is the same whether you reach the retailer via Arkhas or directly; or the ranking of comparison results. Any sponsored or paid content — should it exist in the future — will be clearly labelled "Sponsored", displayed in a separate area, and never included in price-comparison listings.
9. Neutrality and Ranking Policy
Arkhas commits to the following as a declared, binding policy: 1) Ranking within a price comparison is based on availability, then price — the in-stock offer with the lowest price appears first. 2) Ranking is not for sale. No retailer can pay to appear higher in comparison results. 3) Retailers with no commercial relationship with Arkhas are displayed free of charge under the same criteria as all others. 4) Any sponsored content — should it exist — is visually separated and clearly labelled.
10. Permitted and Prohibited Use
You may use the Platform for personal, non-commercial purposes. You are prohibited from: — Copying or extracting the Platform's database, in whole or in part, by automated means. — Using the Content commercially or republishing it without written permission. — Attempting to breach, disrupt or bypass the Platform's security measures. — Sending intensive automated requests that affect the Platform's performance. — Using the Platform in violation of applicable Kuwaiti law.
11. External Links and Websites
The Platform contains links to external retailer websites outside our control. Arkhas bears no responsibility for those sites' content, policies, privacy practices, or any damage arising from their use. Your use of those sites is governed by their own terms.
12. Limitation of Liability
Subject to Law No. 39/2014 on Consumer Protection and any other mandatory rules of Kuwaiti law, and to the extent permitted by law: — The Service is provided "as is", without express or implied warranty of the accuracy, completeness or continuity of the displayed data. — Arkhas does not warrant that the displayed price, availability or specifications match what the retailer offers at the moment of purchase. — Arkhas is not responsible for purchasing decisions made by the User based on the displayed information. — Arkhas is not responsible for any dispute arising between the User and a Retailer. Note: this clause is not intended to exempt Arkhas from any liability from which Kuwaiti law does not permit exemption, nor to waive any consumer right established by law. If any part of this clause is held invalid, the remaining provisions remain in force.
13. Service Availability
Arkhas strives to keep the Service continuously available but does not guarantee it will be uninterrupted. It may modify, suspend or discontinue the Service, in whole or in part, at any time for technical, operational or regulatory reasons.
14. Complaints and Error Correction
If you notice an incorrect price or piece of information, please contact us at [email protected]. We commit to reviewing the report within three working days and correcting the error once verified.
15. Changes to the Terms
Arkhas may amend these Terms at any time. The date of the last update is published at the top of this page. Continued use of the Platform after publication constitutes acceptance of the amended version. For material changes, we will endeavour to notify users by appropriate means.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Kuwait. The Kuwaiti courts have exclusive jurisdiction over any dispute arising from the use of the Platform or relating to these Terms. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain valid and in force.
